Introduction

Welcome to Accraaa. These Terms of Service ("Terms") govern your access to and use of the Accraaa mobile application, website, and related services (collectively, the "Platform") operated by Accraaa ("we," "our," or "us").

By downloading, installing, or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and Accraaa, governed by the laws of the Republic of Ghana.

Acceptance of Terms

By accessing or using Accraaa's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These terms apply to all users of the Platform, including:

• •Customers: Users who browse venues, make reservations, and attend events
• •Venue Owners: Businesses that list their venues on the Platform
• •DJs & Entertainers: Performers who register and promote through the Platform

Eligibility & User Accounts

Age Requirement

You must be at least 18 years old to create an account and use our services. By using Accraaa, you represent and warrant that you meet this age requirement.

Account Responsibilities

• •You are responsible for maintaining the confidentiality of your account credentials
• •You must provide accurate, current, and complete information during registration
• •You agree to update your information promptly if it changes
• •One person or business may not maintain multiple accounts
• •You are responsible for all activities that occur under your account
• •Notify us immediately of any unauthorized use of your account

Services Description

Accraaa is a platform that connects users with nightlife venues, restaurants, and entertainment options in Ghana. Our services include:

• •Venue Discovery: Browse and search for venues based on location, type, and preferences
• •Table Reservations: Book tables at participating venues with deposit payment
• •Crowd Level Indicators: Real-time venue occupancy information
• •Event Listings: Discover upcoming events and parties
• •DJ Profiles: Find and follow DJs performing at venues
• •Venue Management: Tools for venue owners to manage listings and reservations

Reservations & Payments

Booking Process

• •All reservations are subject to venue availability and confirmation
• •Reservations may require a deposit, which will be clearly stated before booking
• •Deposits may be applied toward your minimum spend at the venue
• •You will receive a confirmation with a unique booking code

Payment Processing

• •Payments are processed securely through Paystack
• •We accept mobile money (MTN, Vodafone, AirtelTigo) and card payments
• •All prices are displayed in Ghana Cedis (GHS)
• •Transaction fees may apply and will be disclosed before payment

Cancellation Policy

• •Cancellation policies vary by venue and will be clearly stated at booking
• •Full Refund: Typically available 24+ hours before reservation
• •Partial Refund: May apply for cancellations within 24 hours
• •No-Shows: May result in forfeiture of deposit

Refunds

Refunds are processed within 5-10 business days and returned to the original payment method. Refund eligibility depends on the venue's cancellation policy and timing of the cancellation request.

Venue Owner Terms

If you register as a venue owner, the following additional terms apply:

Listing Requirements

• •You must provide accurate venue information, photos, and operating hours
• •You must have legal authority to represent and manage the venue
• •Venue verification may be required before listing goes live

Commission & Payouts

• •Accraaa charges a platform commission on each transaction (varies by subscription tier)
• •Payouts are available after a 7-day settlement period
• •Minimum payout amount is GHS 200
• •Payout transfer fees apply as disclosed in the dashboard

Subscription Tiers

• •Free: Basic listing with 3% platform commission
• •Basic: Enhanced features with 2% platform commission
• •Premium: Priority support with 1% platform commission
• •Enterprise: Custom solutions with 0% platform commission

Mobile Application Terms

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Accraaa mobile application on your personal device for personal, non-commercial use.

App Store Terms

• •Your use of the app is also subject to the applicable app store terms (Apple App Store, Google Play Store)
• •App store providers are not responsible for the app or its content
• •In case of conflict, these Terms take precedence over app store terms

Device Permissions

• •Location: Required for venue discovery and crowd level features
• •Push Notifications: Used for booking confirmations and updates
• •Camera: Optional, for QR code scanning and profile photos

Updates

We may release updates to the app that include new features, bug fixes, or security patches. You agree to install updates promptly to ensure optimal functionality and security.

Prohibited Conduct

You agree not to:

• •Use the Platform for any illegal or unauthorized purpose
• •Violate any laws or regulations in Ghana or your jurisdiction
• •Harass, abuse, threaten, or discriminate against other users or venues
• •Post false, misleading, or fraudulent reviews or content
• •Attempt to manipulate crowd level data or booking systems
• •Create multiple accounts or use fake identities
• •Scrape, copy, or collect data from the Platform without permission
• •Reverse engineer, decompile, or attempt to extract source code
• •Introduce viruses, malware, or other harmful code
• •Interfere with the Platform's operation or other users' access
• •Commit payment fraud or chargebacks

Intellectual Property

The Accraaa name, logo, and all related trademarks, service marks, and branding are the property of Accraaa. All content on the Platform, including text, graphics, logos, icons, images, audio, and software, is owned by us or our licensors and protected by intellectual property laws.

You may not use, reproduce, distribute, or create derivative works from our content without prior written permission.

By posting content (reviews, photos, etc.) on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services.

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• •Warranties of merchantability, fitness for a particular purpose, or non-infringement
• •That the service will be uninterrupted, secure, or error-free
• •That venue information, crowd levels, or other data will be accurate

Accraaa acts as a marketplace connecting users with venues. We do not own, operate, or control the venues listed on our Platform. Venues are solely responsible for their services, products, and actions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• •Accraaa shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• •Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• •We are not liable for venue actions, service quality, or experiences at venues
• •We are not responsible for personal injury or property damage at venues

Indemnification

You agree to indemnify, defend, and hold harmless Accraaa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content posted on the Platform.

Termination

We may suspend or terminate your account at any time for:

• •Violation of these Terms of Service
• •Fraudulent or illegal activity
• •At our sole discretion with reasonable notice

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Platform ceases immediately.

Dispute Resolution & Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms shall be resolved as follows:

• 1.Informal Resolution: We encourage you to contact us first to resolve any issues informally
• 2.Mediation: If informal resolution fails, parties agree to attempt mediation
• 3.Jurisdiction: Courts in Accra, Ghana shall have exclusive jurisdiction

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• •We will update the "Last Updated" date at the top of this page
• •For material changes, we will notify you via email or in-app notification
• •Continued use of the Platform after changes constitutes acceptance

General Provisions

• •Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect
• •Waiver: Our failure to enforce any right or provision does not constitute a waiver
• •Entire Agreement: These Terms constitute the entire agreement between you and Accraaa
• •Assignment: You may not assign your rights under these Terms without our consent
